This Privacy Policy describes how BVL Holdings LLC (“BVL,” “we,” “us,” or “our”) collects, uses, and discloses Personal Information in connection with getbevel.com and any related pages, emails, text messages, subscriptions, and rewards programs (collectively, the “Services”). As used in this Privacy Policy, “Personal Information” shall mean information that identifies, relates to, or could reasonably be linked to you or your household. By using the Services, you acknowledge the practices described in this Privacy Policy.

1.               Information We Collect

(a)             Information You Provide. We collect information you give us when you place an order, create an account, subscribe, join our rewards program, sign up for emails or text messages, leave a review, or contact customer service. This includes your name, email address, phone number, shipping address, billing address, order and subscription details, date of birth (if you join our rewards program), reviews, and the content of your communications with us. Payment card information is collected and processed by our payment processors, and we do not store full payment card numbers.

(b)             Information Collected Automatically. When you use the Services, we and our partners automatically collect information through cookies, pixels, and similar technologies, including your IP address, device and browser type, approximate location derived from your IP address, pages viewed, links clicked, referring websites, and purchase activity.

(c)             Information from Third Parties. We do not purchase Personal Information from third parties. We may receive information from our service providers in connection with the Services they provide to us, such as delivery status from shipping carriers.

2.               How We Use Information

We use Personal Information to:

•        process and deliver orders, subscriptions, returns, and refunds;

•        administer our rewards program;

•        provide customer service and respond to your requests;

•        send transactional messages and, with your consent where required, marketing emails and text messages;

•        analyze and improve the Services;

•        show you advertising for our products, including on third-party websites and platforms; and

•        prevent fraud, protect the security of the Services, enforce our terms, and comply with law.

3.               How We Disclose Information

We disclose Personal Information to the following categories of recipients:

•        Service Providers. Companies that perform services for us, including website hosting and e-commerce, payment processing, subscription management, rewards and reviews, email and text messaging, customer service, shipping, order tracking and returns, and analytics.

•        Advertising Partners. Advertising and social media companies, such as Meta, Google, and TikTok, that collect information through cookies and pixels on the Services to measure and deliver advertising. See Section 4.

•        Legal and Safety. Government authorities, courts, or other parties where we believe disclosure is required by law or necessary to protect the rights, property, or safety of BVL, our customers, or others.

•        Business Transfers. A buyer, successor, or other party in connection with a merger, acquisition, financing, sale of assets, or similar transaction, including in bankruptcy.

We do not sell or rent customer lists to third parties for their own marketing purposes.

4.               Cookies, Pixels, and Targeted Advertising

(a)             We and our advertising partners use cookies, pixels, and similar technologies to operate the Services, understand how visitors use the Services, and show you advertising for our products on other websites and platforms based on your activity. Under some state privacy laws, this use may be considered a “sale” or “sharing” of Personal Information or “targeted advertising.”

(b)             You may opt out of this use by: (i) selecting “Decline” on our cookie banner; (ii) enabling a Global Privacy Control signal in your browser, which we treat as a request to opt out for that browser; or (iii) emailing us at info@getbevel.com with the subject line “Do Not Sell or Share.” You may also adjust your browser settings to block or delete cookies. Some features of the Services may not function properly if cookies are disabled.

(c)             Other than Global Privacy Control, we do not currently respond to browser “Do Not Track” signals.

5.               Email and Text Messages

You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing email. You may opt out of marketing text messages at any time by replying “STOP.” Consent to receive marketing text messages is not a condition of purchase. We may still send you transactional messages relating to your orders, subscription, or account.

6.               Rewards Program and Notice of Financial Incentive

We offer a rewards program and may offer discounts for signing up for emails, text messages, or subscriptions (each, a “Program”). When you join a Program, we collect your name, email address, phone number (if provided), date of birth (for rewards), and purchase activity, and we use this information to administer the Program and as otherwise described in this Privacy Policy. Participation is voluntary. You may join by signing up through the Services, and you may withdraw at any time by contacting us at info@getbevel.com or unsubscribing. We believe the value of the benefits offered is reasonably related to the value of your Personal Information to us, which we estimate based on the costs of offering the Program and the revenue we expect from Program participants. The terms of each Program are described on the Services.

7.               Data Retention

We retain Personal Information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including maintaining your account and order history while your account is active, administering our Programs, and complying with our legal, tax, accounting, and recordkeeping obligations, unless you ask us to delete it and we are not required or permitted to keep it.

8.               Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No method of transmission or storage is completely secure, and we cannot guarantee the security of your information.

9.               Children

The Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. We do not knowingly sell or share the Personal Information of consumers under 16. If you believe a child has provided us with Personal Information, please contact us and we will delete it.

10.            Your Privacy Rights

(a)             Depending on the state where you live, you may have the right to: (i) know and access the Personal Information we have collected about you; (ii) correct inaccurate Personal Information; (iii) delete your Personal Information; (iv) receive a copy of your Personal Information in a portable format; and (v) opt out of the sale or sharing of your Personal Information and targeted advertising.

(b)             To exercise these rights, email us at info@getbevel.com. We will verify your request by matching information you provide with information we have on file. You may designate an authorized agent to make a request on your behalf, and we may require proof of the agent’s authority and verification of your identity. We will respond within the time required by law.

(c)             If we deny your request, you may appeal by emailing info@getbevel.com with the subject line “Privacy Appeal.” If your appeal is denied, you may contact the attorney general of your state.

(d)             We will not discriminate against you for exercising any of these rights.

(e)             In the past 12 months, we have collected the following categories of Personal Information: identifiers (such as name, email address, phone number, postal address, and IP address); customer records (such as billing address and payment information); age (date of birth); commercial information (such as purchase and subscription history); internet or other electronic network activity; and approximate geolocation. We collect this information from the sources described in Section 1, for the purposes described in Section 2, and disclose it to the categories of recipients described in Section 3. We sell or share identifiers, commercial information, and internet or other electronic network activity with our advertising partners for targeted advertising. We do not use or disclose sensitive personal information for purposes other than those permitted by law.

(f)              California residents may request information about our disclosure of Personal Information to third parties for their own direct marketing purposes. We do not make such disclosures.

11.            Users Outside the United States

The Services are operated in the United States. If you use the Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country.

12.            Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated Privacy Policy on the Services and update the “Last Updated” date above. If we make material changes, we will provide additional notice as required by law.
